Right of withdrawal

Right to withdraw

Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you and other than the carrier, took possession of the goods.

To exercise the right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, or an email). You may use the attached model withdrawal form for this purpose, but it is not mandatory.

The easiest way to withdraw is right in your account: open the relevant order in your orders list and use the withdrawal button there. The methods above (letter or email) of course remain equally available.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

How AlpenHigh issues refunds. Where you paid by cryptocurrency, the refund is sent as a same-coin withdrawal: you enter a payout wallet address via the link in your refund notification before it goes out. Where you paid by cash by letter, the refund is repaid by SEPA bank transfer to an account you provide. All other refunds return via the original means of payment, as described above.

Exceptions to the right of withdrawal (§ 18 FAGG)

The right of withdrawal does not apply to contracts for

  • the supply of goods made to the consumer's specifications or clearly personalised (§ 18 (1) Z 3 FAGG);
  • the supply of goods which are liable to deteriorate or expire rapidly (§ 18 (1) Z 4 FAGG);
  • the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (§ 18 (1) Z 5 FAGG).

These exceptions apply per individual product — not as a blanket rule for an entire range. Where an exception applies to a concrete article in your order, we flag it by name at checkout and obtain your explicit waiver before contract conclusion (FAGG § 18 (2)).

Live Cuttings

Articles concretely labelled as cuttings are live, rapidly perishable goods and therefore fall under the § 18 (1) Z 4 FAGG exception ("goods liable to deteriorate rapidly"); there is no right of withdrawal or return for them.

This classification applies only to articles labelled "cutting" (live plant) in the shop. Cannabis seeds, other shop products and accessories are not covered by this exception — the full 14-day right of withdrawal applies to them.

Live cuttings are cut to order and need rooting time; they therefore ship about 2–3 weeks after payment is received.

On a voluntary basis (goodwill, no legal entitlement) you may still request a refund for cuttings; AlpenHigh decides on such requests at its own discretion, case by case. You do not need to return the cuttings — we cannot reuse them anyway. This does not create a statutory right of withdrawal.

You confirm the waiver of the right of withdrawal for live cuttings at checkout per article, before contract conclusion. This does not affect your statutory warranty rights (§§ 922 ff. ABGB) for transport damage or defective goods — please contact office@alpenhigh.eu promptly in such cases.

Gift cards

Buying a gift card carries the full 14-day right of withdrawal. None of the exceptions above applies to gift cards.

How we settle a withdrawal depends on whether the card has already been redeemed:

  • Not yet redeemed: we cancel the card and refund the purchase price in full. The code stops working.
  • Already redeemed: the amount is sitting as store credit on the account of the person who redeemed it. Write to office@alpenhigh.eu in that case — we refund the credit still available at that point.

You do not need to use this form. The easiest way to withdraw is the withdrawal button right on your order in your order overview — one click, no form at all. Only if you prefer to withdraw by email or letter, you can use the following statutory model:
