Right to withdraw

Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you and other than the carrier, took possession of the goods.

To exercise the right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, or an email). You may use the attached model withdrawal form for this purpose, but it is not mandatory.

For many orders you can also declare the withdrawal directly in your account: open the relevant order in your orders list. If a withdrawal button is shown there, one click is enough. That button is an additional convenience and is not available for every order status, for example while a parcel is still in transit. The methods above, a letter or an email to the address given, are the legally decisive ones and are always available.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

How AlpenHigh issues refunds. What we refund is always the euro amount you paid. Where you paid by cryptocurrency, we refund in the same currency as a rule: you enter a payout wallet address via the link in your refund notification, and the euro amount is converted into the coin amount at the time of payout. If a payout in that currency is not possible, for example because we no longer support the currency or you cannot supply an address, we will agree another means of payment with you, such as a SEPA bank transfer. You never incur any cost as a result. Where you paid by cash by letter, a refund in cash is not possible, so we transfer the amount by SEPA to an account you give us. All other refunds return via the original means of payment, as described above.

Exceptions to the right of withdrawal (§ 18 FAGG)

The right of withdrawal does not apply to contracts for

  • the supply of goods made to the consumer's specifications or clearly personalised (§ 18 (1) Z 3 FAGG);
  • the supply of goods which are liable to deteriorate or expire rapidly (§ 18 (1) Z 4 FAGG);
  • the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (§ 18 (1) Z 5 FAGG).

These exceptions always apply to the individual article, never as a blanket rule for an entire range. Where an article is excluded from the right of withdrawal, we inform you of that before the contract is concluded (§ 4 (1) no. 11 FAGG). For live cuttings we additionally obtain your explicit confirmation at checkout that you have taken note of the article concerned and of the loss of the right of withdrawal.

Live Cuttings

Articles concretely labelled as cuttings are live, rapidly perishable goods and therefore fall under the § 18 (1) Z 4 FAGG exception ("goods liable to deteriorate rapidly"); there is no right of withdrawal or return for them.

This classification applies only to articles labelled "cutting" (live plant) in the shop. The full 14-day right of withdrawal applies to cannabis seeds. It applies to every other article in the shop that is not labelled as a cutting as well, unless we tell you expressly before the contract is concluded that one of the exceptions listed above applies to a particular article (§ 4 (1) no. 11 FAGG).

Live cuttings are cut fresh to order and need rooting time. Dispatch therefore usually happens around 2 to 3 weeks after payment is received. How long rooting takes depends on the plant and the season, so in individual cases it can take longer. If dispatch is delayed, you can set us a reasonable additional period and withdraw from the contract once it has passed (§ 7a KSchG).

On a voluntary basis (goodwill, no legal entitlement) you may still request a refund for cuttings; AlpenHigh decides on such requests at its own discretion, case by case. You do not need to return the cuttings — we cannot reuse them anyway. This does not create a statutory right of withdrawal.

At checkout you confirm, per article and before the contract is concluded, that you have taken note of the loss of the right of withdrawal for live cuttings. This does not affect your statutory warranty rights under the Consumer Warranty Act (VGG): they run for two years from delivery, and a defect that shows up in the first year is presumed to have been there on delivery (§ 11 VGG). For transport damage or defective goods, please contact office@alpenhigh.eu promptly.

Gift cards

Buying a gift card carries the full 14-day right of withdrawal. None of the exceptions above applies to gift cards.

Because a gift card is delivered electronically only (no goods are shipped), the 14-day period here runs from the day the contract is concluded — the day you place the gift-card order (§ 11 (2) FAGG).

How we settle a withdrawal depends on whether the card has already been redeemed:

  • Not yet redeemed: we cancel the card and refund the purchase price in full. The code stops working.
  • Already redeemed: the amount is sitting as store credit on the account of the person who redeemed it. Write to office@alpenhigh.eu in that case — we refund the credit still available at that point.
